Closed Case and No Refund

Description

I purchased an item on ebay. It was pre sale so I decided to contact the seller for a refund. He was taking long so i opened a case. While it was on review He told me to cancel it because he could not send the refund while the case was open, and I did. Than he told me he still cant cancel the order ebay wont let him. Than I didnt believe him so I opened another case on this item this time I had to choose anther option that was unauthorized access. I know thats not the case but I assumed when paypal see my problem they handle it. This was not the case they closed it and I got no refund since they found no breach on my account obviously.Now I am not protected against this case.Can the seller refund me? and if he cant or dont want to, and he never ship my item (pre sale) will I loose my money? please help.
